When should I make a Power of Attorney

A power of attorney can be made by anyone over the age of 18 whilst they have decision making capacity.

You cannot make a power of attorney after you have been deemed to have lost your decision making capacity.

Before making a power of attorney, you should carefully consider the following:

  • Have you had a conversation with whom you wish to appoint as your attorney, to ensure they are able and willing to manage your affairs on your behalf?
  • Does your chosen attorney understand the way you wish them to manage your affairs?
  • Are there any limitations you wish to place on your attorney’s powers?
  • Have you thought about the full scope of responsibilities you are assigning to your attorney?
