What is probate?
A Grant of Probate gives someone the legal right to administer the estate of a deceased person’s Will. Probate is a critical legal step needed before the estate can be administered and any bequests distributed to beneficiaries. A Grant of Probate is a document issued by the Supreme Court certifying the Will of the deceased person is valid. It also confirms the appointment of an Executor, the person or organisation responsible for estate administration.
Applying for probate
When you apply for probate, you need to be mindful that:
- The Will is an original document
- It must be the last valid Will made by the deceased
- People may contest the Will
